AGREEMENT
- Scope
- Article 1

- The accommodation contract (including the day use contract and the shower use contract) and any related contracts that Rembrandt Cabin Shinjuku Shin-Okubo (hereinafter referred to as "this hotel") enters into with its guests (including day use guests and shower users; the same applies below) shall be governed by these terms and conditions, and any matters not provided for in these terms and conditions shall be governed by laws, regulations or generally established practices.
- In cases in which the Hotel has entered into a special contract with the Guest insofar as such special contract does not violate laws, regulations and generally accepted practices, notwithstanding the provisions of the preceding paragraph, the special contract shall take precedence over the provisions of the preceding paragraph.
- Application for accommodation contract

- A Guest who intends to apply for an Accommodation Contract with the Hotel shall provide the Hotel with the following particulars:
- Name of guest (applicant)
- Gender of the guest
- Date of stay and expected check-in time
- contact address
- Other particulars deemed necessary by the Hotel
- A Guest who intends to apply for an Accommodation Contract with the Hotel shall provide the Hotel with the following particulars:
- Establishment of the accommodation contract
- Article 3

- An accommodation contract shall be deemed to have been established when the Hotel accepts the application. However, this shall not apply when the Hotel proves that it has not accepted the application.
- Refusal to enter into an accommodation contract
- Article 4

- The Hotel may refuse to enter into an Accommodation Contract under any of the following circumstances:
- When the application for accommodation does not conform to these terms and conditions
- When the capsule unit is fully booked and there are no spare capsule units available
- When the person seeking accommodation can be clearly determined to be infected with an infectious disease
- When the person seeking accommodation is likely to engage in gambling or other illegal activities or conduct that disrupts public morals
- When the person requesting accommodation is deemed to be intoxicated or otherwise causing a significant nuisance to other guests
- When a guest behaves in a manner that significantly disturbs other guests
- (1) When the person is an organized crime group as defined in Article 2, Paragraph 2 of the Law Concerning Prevention of Unjust Acts by Organized Crime Members (Law No. 77 of 1991) (hereinafter referred to as an "organized crime group"), an organized crime member as defined in Paragraph 6 of the same Law (hereinafter referred to as an "organized crime member"), an associate member of an organized crime group or a person related to an organized crime group or other anti-social force, or a person who has not yet passed five years since the day on which he or she ceased to be an organized crime member, (2) when the person is a corporation or other organization whose business activities are controlled by an organized crime group or an organized crime member, or (3) when the person is a corporation that has an individual among its officers who is a member of an organized crime group.
- When violent demands are made in relation to the accommodation, or an unreasonable burden is requested.
- When it is impossible to provide accommodation due to natural disasters, malfunctions of facilities, or other unavoidable reasons
- Other cases where the circumstances fall under the provisions of applicable prefectural ordinances in the area in which the Hotel is located.
- The Hotel may refuse to enter into an Accommodation Contract under any of the following circumstances:
- Guest's Right to Cancel Accommodation Contract
- Article 5

- The Guest may cancel the Accommodation Contract by notifying the Hotel.
- If a Guest does not arrive by midnight on the day of accommodation without contacting the Hotel, the Hotel may regard the Accommodation Contract as having been cancelled by the Guest.
- If a guest cancels the accommodation agreement due to reasons attributable to the guest, a penalty will be charged as follows:

- Right to Cancel Hotel Contract
- Article 6

- The Hotel may cancel the Accommodation Contract under any of the following circumstances:
- When the Guest is deemed liable to conduct himself/herself in a manner that will violate the laws, public order or good morals in regard to his/her accommodation, or when he/she is deemed to have conducted himself/herself in such a manner
- When the Guest can be clearly determined to be infected with an infectious disease
- When a guest behaves in a manner that significantly disturbs other guests
- When the guest is a member of an organized crime group, a gang member, a semi-regular member of an organized crime group, or a related party to an organized crime group or other antisocial forces
- When the company is a corporation or other organization whose business activities are controlled by an organized crime group or its members
- When a corporation has an executive officer who is a member of an organized crime group
- When the Guest makes violent demands or is asked to assume an unreasonable burden in relation to his/her stay
- When it is impossible to provide accommodation due to a natural disaster or other force majeure
- When the Guest engages in smoking (including electronic cigarettes) within the Hotel, tampering with firefighting equipment, or other prohibited activities in the Hotel Usage Regulations (limited to those necessary for fire prevention) stipulated by the Hotel.
- Other cases where the circumstances fall under the provisions of applicable prefectural ordinances in the area in which the Hotel is located.
- When the Hotel has cancelled the Accommodation Contract in accordance with the preceding paragraph, the Hotel shall not charge the Guest for any accommodation services etc. which he has not yet received.
- The Hotel may cancel the Accommodation Contract under any of the following circumstances:

- The Guest will be required to register the following particulars at the Hotel front desk on the day of accommodation:
- Guest's name, address, gender, age, occupation
- If the guest is a foreigner not residing in Japan, his/her nationality, passport number
- Departure Date
- Other particulars deemed necessary by the Hotel
- If the Guest intends to make the payment as provided for in Article 11 by any means other than Japanese currency, such as accommodation coupons or credit card, these shall be presented in advance at the time of the registration as provided for in the preceding paragraph.
- The Guest will be required to register the following particulars at the Hotel front desk on the day of accommodation:

- Guests may use the capsule unit from 2 p.m. to 10 a.m. the following morning. Even if you are staying for consecutive nights, you will not be able to use the unit between 10 a.m. and 2 p.m.
- Observance of the rules of use

- While within the premises of the Hotel, Guests shall observe the Usage Regulations established by the Hotel and posted within the Hotel, as well as any other notices and instructions.

- The opening hours of the main facilities of our Hotel are as follows:
- Front desk: 24 hours
- Showers: 24 hours
- Lounge Desk: 24 hours
- The hours set out in the preceding paragraph may be subject to temporary change due to unavoidable circumstances. In such cases, we will notify you by appropriate means.

- Payment of accommodation fees, etc. shall be made at the front desk at the time of check-in or when requested by the Hotel in currency or by any other means acceptable to the Hotel, such as accommodation coupons or credit cards.
- Even if the Hotel has provided the Guest with a capsule unit and it is available for use, and the Guest chooses not to stay, the accommodation fee will still be charged.
- Liability of the Hotel

- The Hotel shall compensate the Guest for damages caused to the Guest in the fulfillment or nonfulfillment of the Accommodation Contract and/or related agreements, unless such damages have been caused by reasons beyond the Hotel's control.
- Our hotel is covered by hotel liability insurance to cover the unlikely event of a fire or other incident.
- Handling when contracted capsule units cannot be provided

- When the hotel is unable to provide the guest with the contracted capsule unit, it will, with the guest's consent, arrange for the guest to stay in accommodation at another facility with similar conditions as far as possible.
- Notwithstanding the provisions of the preceding paragraph, if the Hotel is unable to arrange alternative accommodations for the Guest, the Hotel shall assume the amount of compensation equivalent to the breach of contract charges stipulated in Article 5, Paragraph 3 and pay this to the Guest. However, the Hotel shall not pay compensation if the inability to provide a room is due to reasons beyond the Hotel's control.
- Handling of carry-on items

- Guests are responsible for managing their own items, cash and valuables brought into the Hotel.
- The Hotel shall not be liable for any loss, breakage or other damage caused to goods, cash or valuables brought into the Hotel by the Guest, except in cases where this is due to willful misconduct or gross negligence on the part of the Hotel.
- Guest baggage

- When the baggage of the Guest is brought into the Hotel prior to his/her stay, it shall be kept by the Hotel only with the consent of the Hotel in advance and shall be handed over to the Guest at the time of his/her check-in.
- If a guest's baggage or belongings are found left behind at the hotel after checking out, the hotel will deal with the matter according to the owner's contact and instructions. If there is no instruction from the owner or the owner cannot be identified, the hotel will store the item for seven days, including the day it was found, and then dispose of it or deliver it to the appropriate authorities. However, food and drink will be disposed of on the same day.

- When the Hotel suffers damage caused through intention or negligence on the part of the Guest, the Guest will compensate the Hotel for the damage.

- The use of computer communications from within the Hotel is at the customer's own risk. The Hotel shall not be held liable for any damage suffered by the user as a result of service interruptions caused by system failures or other reasons during the use of computer communications. Furthermore, if damage is caused to the Hotel or a third party as a result of actions that the Hotel deems inappropriate when using computer communications, the customer shall compensate for such damage.
